Where a road user or other person(s) contravenes section 46(4) Transport Infrastructure Act 1994 (Qld), that is, drive past a restricted road use notice unlawfully, no liability for damage or injury caused directly by the act is attached to the chief executive or State of Queensland.56
Further, where approval is provided by the chief executive to drive past a restricted road use notice57 and the approval was given in good faith without reckless disregard for the possible occurrence of the personal injury or loss or damage to property from which liability would arise if the subsection did not apply, then no liability attaches to the chief executive or police commissioner. In the alternative, where liability does not attach to the chief executive or police commissioner, then it attaches to the State of Queensland.
