79JEffect of administrative disqualification#

  1. (1)This section applies in relation to an administrative disqualification of a person.
  2. (2)On the day the administrative disqualification period for the person starts, the person is taken to have been convicted of an offence against section 79(2)(a) or (b) for the purposes of—
  3. (a)section 79, 86 or 87; and
  4. (b)part 3A; and
  5. (c)part 3B; and
  6. (d)section 127 as if the conviction of an offence against section 79(2)(a) or (b) under this section resulted in the person being disqualified.
  7. (3)However, if the administrative disqualification of the person immediately ends under section 79I(5)—
  8. (a)the person is taken not to have been convicted of the offence despite subsection (2); and
  9. (b)the person's Queensland driver licence is taken not to have been cancelled despite subsection (2) and section 127; and
  10. (c)the person is entitled, if the person complied with section 130, to have the person's Queensland driver licence returned within a reasonable period.
