(8C)Police officer may require specimen if person at hospital#
If a person whom a police officer may require under subsection (2), (2AA), (2A) or (2AAA) to provide a specimen of breath for a breath test, or a specimen of saliva for a saliva test, by the person (an authorising requirement) is at the hospital for treatment, that person may be required by any police officer to provide at the hospital— (a) if the specimen that may be required under the authorising requirement is a specimen of breath—a specimen of the person’s breath for analysis by a breath analysing instrument or a specimen of the person’s blood for a laboratory test; or (b) if the specimen that may be required under the authorising requirement is a specimen of saliva—a specimen of the person's saliva for saliva analysis or a specimen of the person's blood for a laboratory test.
