187Stopping in a bus lane, bus only lane, tram lane, tramway, transit lane, truck lane or on tram tracks#

  1. (1)A driver must not stop in a bus lane, transit lane or truck lane, unless the driver—
  2. (a)is—
  3. (i)driving a bus or taxi; and
  4. (ii)dropping off, or picking up, passengers; or
  5. (b)is permitted to drive in the lane under this regulation. Maximum penalty—20 penalty units.
  6. (2)A driver (except the driver of a tram, a tram recovery vehicle or a bus) must not stop in a tram lane, a tramway or on tram tracks. Maximum penalty—20 penalty units.
  7. (3)A driver must not stop in a bus only lane unless the driver—
  8. (a)is driving a bus and is dropping off, or picking up, passengers; and
  9. (b)is permitted to drive in the bus only lane under this regulation. Maximum penalty—20 penalty units.

188Stopping in a shared zone#

A driver must not stop in a shared zone unless—

  1. (a)the driver stops at a place on a length of road, or in an area, to which a parking control sign applies and the driver is permitted to stop at that place under the Act; or
  2. (b)the driver—
  3. (i)stops in a parking bay; and
  4. (ii)is permitted to stop in the parking bay under this regulation; or
  5. (c)the driver is dropping off, or picking up, passengers or goods; or
  6. (d)the driver is engaged in the door-to-door delivery or collection of goods, or in the collection of waste or garbage. Maximum penalty—20 penalty units.

189Double parking#

  1. (1)A driver must not stop on a road if to do so would put any part of the vehicle that the driver is driving between a vehicle that is parked on the road and the centre of the road. Maximum penalty—20 penalty units.
  2. (2)A driver does not contravene subsection (1) by parking on the side of the road, or in a median strip parking area, in accordance with section 210.

190Stopping in or near a safety zone#

  1. (1)A driver (other than the rider of a bicycle or a personal mobility device) must not stop in a safety zone, or on a road within 10m before or after a safety zone, unless the driver—
  2. (a)stops at a place on a length of road, or in an area, to which a parking control sign applies; and
  3. (b)is permitted to stop at that place under this regulation.
  4. (2)For this section, distances are measured—
  5. (a)in the direction in which the driver is driving; and
  6. (b)from the end of the structure; and
  7. (c)as shown in example 2.
  8. (3)In this section—

191Stopping near an obstruction#

A driver must not stop on a road near an obstruction on the road in a position that obstructs traffic on the road.

192Stopping on a bridge or in a tunnel etc.#

  1. (1)A driver must not stop on a bridge, causeway, ramp or similar structure unless—
  2. (a)the road is at least as wide on the structure as it is on each of the approaches; or
  3. (b)the driver—
  4. (i)stops at a place on a length of road, or in an area, to which a parking control sign applies; and
  5. (ii)is permitted to stop at that place under this regulation.
  6. (2)A driver must not stop in a tunnel or underpass unless—
  7. (a)the road is at least as wide in the tunnel or underpass as it is on each of the approaches; or
  8. (b)the driver—
  9. (i)stops at a place on a length of road, or in an area, to which a parking control sign applies; and
  10. (ii)is permitted to stop at that place under this regulation.

193Stopping on a crest or curve outside a built-up area#

  1. (1)A driver must not stop on or near a crest or curve on a length of road that is not in a built-up area unless—
  2. (a)the driver’s vehicle is visible for 100m to drivers approaching the vehicle and travelling in the direction of travel of traffic on the same side of the road as the vehicle; or
  3. (b)the driver—
  4. (i)stops at a place on a length of road, or in an area, to which a parking control sign applies; and
  5. (ii)is permitted to stop at that place under this regulation.
  6. (2)In this section—

194Stopping near a fire hydrant etc.#

  1. (1)A driver must not stop within 1m of a fire hydrant, fire hydrant indicator, or fire plug indicator, unless—
  2. (a)the driver—
  3. (i)is driving a bus; and
  4. (ii)stops at a bus stop or in a bus zone; and
  5. (iii)does not leave the bus unattended; or
  6. (b)the driver—
  7. (i)is driving a taxi; and
  8. (ii)stops in a taxi zone; and
  9. (iii)does not leave the taxi unattended.
  10. (2)For this section, a driver leaves a vehicle unattended if the driver leaves the vehicle so the driver is over 3m from the closest point of the vehicle.
  11. (3)In this section—

fire hydrant
means an upright pipe with a spout, nozzle or other outlet for drawing water from a main or service pipe in case of fire or other emergency.

195Stopping at or near a bus stop#

  1. (1)A driver (except the driver of a bus) must not stop at a bus stop, or on the road, within 20m before a sign on the road that indicates the bus stop, and 10m after the sign, unless the driver—
  2. (a)stops at a place on a length of road, or in an area, to which a parking control sign applies; and
  3. (b)is permitted to stop at that place under this regulation.
  4. (2)For this section, distances are measured in the direction in which the driver is driving.
  5. (3)In this section—

196Stopping at or near a tram stop#

  1. (1)A driver (except the driver of a tram, a tram recovery vehicle or a bus travelling along tram tracks) must not stop at a tram stop or on the road within 20m before a sign that indicates a tram stop, unless—
  2. (a)the driver stops at a place on a length of road, or in an area, to which a parking control sign applies; and
  3. (b)the driver is permitted to stop at that place under this regulation.
  4. (2)For this section, the distance is measured in the direction in which the driver is driving.
  5. (3)In this section—

197Stopping on a path, dividing strip, nature strip, painted island or traffic island#

  1. (1)A driver must not stop on a bicycle path, footpath, shared path or dividing strip, or a nature strip adjacent to a length of road in a built-up area, unless the driver—
  2. (a)stops at a place on a length of road, or in an area, to which a parking control sign applies; and
  3. (b)is permitted to stop at that place under this regulation.
  4. (1A)A driver must not stop on a painted island.
  5. (1B)A driver must not stop on a traffic island.
  6. (2)Subsections (1) and (1B) do not apply to the rider of a bicycle, a personal mobility device or an animal.

198Obstructing access to and from a footpath, driveway etc.#

  1. (1)A driver must not stop on a road in a position that obstructs access by vehicles or pedestrians to or from a footpath ramp or a similar way of access to a footpath, or a bicycle path or passageway unless—
  2. (a)the driver is driving a bus that is dropping off, or picking up, passengers; or
  3. (b)the driver—
  4. (i)stops in a parking bay; and
  5. (ii)is permitted to stop in the parking bay under this regulation.
  6. (2)A driver must not stop on or across a driveway or other way of access for vehicles travelling to or from adjacent land unless—
  7. (a)the driver—
  8. (i)is dropping off or picking up passengers; and
  9. (ii)does not leave the vehicle unattended; and
  10. (iii)completes the dropping off or picking up of the passengers, and drives on, as soon as practicable and, in any case, within 2 minutes after stopping; or
  11. (b)the driver—
  12. (i)stops in a parking bay; and
  13. (ii)is permitted to stop in the parking bay under this regulation.
  14. (3)For subsection (2)(a)(ii), a driver leaves a vehicle unattended if the driver is more than 3m from the closest part of the vehicle.

199Stopping near a postbox#

  1. (a)A driver must not stop on a road within 3m of a public postbox unless—
  2. (a)the driver is dropping off, or picking up, passengers or mail; or
  3. (b)the driver—
  4. (i)stops at a place on a length of road, or in an area, to which a parking control sign applies; and
  5. (ii)is permitted to stop at that place under this regulation.

Maximum penalty—20 penalty units.

200Stopping on roads—heavy and long vehicles#

  1. (1)The driver of a heavy vehicle, or long vehicle, must not stop on a length of road that is not in a built-up area, except on the shoulder of the road.
  2. (2)Subject to subsections (2A) and (2B), the driver of a heavy vehicle, or long vehicle, must not stop on a length of road in a

built-up area for longer than 1 hour, unless the driver is permitted to stop on the length of road for longer than 1 hour by information on or with a traffic control device.

  1. (2A)The driver of a heavy vehicle, or long vehicle, may stop on a length of road in a built-up area for longer than 1 hour if the driver is engaged in dropping off or picking up goods for all of the period when the vehicle is stopped.
  2. (2B)Subsections (1), (2) and (2A) apply unless a local law otherwise provides.
  3. (3)In this section—
long vehicle
means a vehicle that, together with any load or projection, is 7.5m long, or longer.

201Stopping on a road with bicycle parking sign#

A driver (except the rider of a bicycle or a personal mobility device) must not stop on a length of road to which a bicycle parking sign applies, unless the driver is dropping off, or picking up, passengers.

202Stopping on a road with motorbike parking sign#

A driver (except the rider of a motorbike) must not stop on a length of road to which a motorbike parking sign applies, unless the driver is dropping off, or picking up, passengers.

203Stopping in a parking area for people with disabilities#

  1. (1)A driver must not stop in a parking area for people with disabilities unless—
  2. (a)the driver’s vehicle displays a current parking permit for people with disabilities; and
  3. (b)the driver complies with the conditions of use of the permit.

Maximum penalty—20 penalty units.

  1. (2)A parking area for people with disabilities is a length or area of a road—
  2. (a)to which a permissive parking sign displaying a people with disabilities symbol applies; or
  3. (b)to which a people with disabilities parking sign applies; or
  4. (c)indicated by a road marking (a people with disabilities road marking) that consists of, or includes, a people with disabilities symbol.

203AStopping in a slip lane#

  1. (a)A driver must not stop in a slip lane unless—
  2. (a)a parking control sign applies to the place where the driver stops; and
  3. (b)the driver is permitted to stop at the place under this regulation.

203CStopping in a parking area for the charging of electric-powered vehicles#

  1. (1)A driver must not stop in a parking area for the charging of an electric-powered vehicle unless—
  2. (a)the driver’s vehicle is an electric-powered vehicle; and
  3. (b)the electric-powered vehicle—
  4. (i)is plugged in to an external source of electricity; or
  5. (ii)is being plugged in to an external source of electricity; or
  6. (iii)has just been unplugged from an external source of electricity.

Maximum penalty—20 penalty units.

  1. (2)A parking area for the charging of an electric-powered vehicle is a length or area of a road—
  2. (a)to which a permissive parking sign displaying an electric-powered vehicle symbol applies; or
  3. (b)to which an electric-powered vehicle charging parking sign applies; or
  4. (c)indicated by a road marking that consists of, or includes, an electric-powered vehicle symbol.

  1. (3)An electric-powered vehicle is a vehicle that—
  2. (a)is powered by 1 or more electric motors or traction motors, regardless of whether the vehicle is also powered by another form of propulsion; and
  3. (b)can be recharged from an external source of electricity.
