11Regulation applies to vehicles and road users on roads and road-related areas#

  1. (1)This regulation applies to vehicles and road users on roads and road-related areas.
  2. (2)A reference in this regulation (except in this division) to a road includes a reference to a road-related area, unless otherwise expressly stated in this regulation.

12Section number not used#

  1. (1)A road-related area is any of the following—
  2. (a)an area that divides a road;
  3. (b)a footpath or nature strip adjacent to a road;
  4. (c)an area that is not a road and that is open to the public and designated for use by cyclists or animals;
  5. (d)an area that is not a road and that is open to, or used by, the public for parking vehicles.
  6. (2)However, unless the contrary intention appears, a reference in this regulation (except this division) to a road-related area includes a reference to—
  7. (a)any shoulder of a road; and
  8. (b)any other area that is a footpath or nature strip as defined in the dictionary.
  9. (3)In this section—
shoulder, of a road
includes any part of the road that is not designed to be used by motor vehicles in travelling along the road; and includes— for a kerbed road—any part of the kerb; and for a sealed road—any unsealed part of the road, and any sealed part of the road outside an edge line on the road; but does not include a bicycle path, footpath or shared path.

Division 2Road users and vehicles#

14Road users#

A road user is a driver, rider, passenger or pedestrian.

15What is a vehicle#

A vehicle includes—

  • (a) a motor vehicle, trailer and tram; and
  • (b) a bicycle; and
  • (c) a personal mobility device; and
  • (d) an animal-drawn vehicle, and an animal that is being ridden or drawing a vehicle; and
  • (e) a combination;

but does not include a motorised mobility device, a wheelchair, a train, a wheeled recreational device or a wheeled toy.

15APersonal mobility devices—Act, sch 4, definition personal mobility device#

  1. (1)For schedule 4 of the Act, definition personal mobility device, paragraph (b), a vehicle is a personal mobility device if the vehicle—
  2. (a)has 1 or more wheels; and
  3. (b)is propelled by an electric motor; and
  4. (c)does not exceed any of the following dimensions—
  5. (i)a width of 750mm;
  6. (ii)a height of 1,350mm;
  7. (iii)if the vehicle has 2 or more axles—a wheelbase of 1,100mm; and
  8. (d)weighs 60kg or less when not carrying a person or other load; and
  9. (e)when propelled only by the electric motor, can not exceed a speed of 25km/h.
  10. (2)However, each of the following is not a personal mobility device—
  11. (a)a low powered toy scooter;
  12. (b)a motorised mobility device;
  13. (c)a vehicle with pedals;
  14. (d)a vehicle that is registered and, in connection with that registration, has a number plate attached.

16Who is a driver#

A driver is the person who is driving a vehicle (except a motorbike, bicycle, personal mobility device, animal or animal-drawn vehicle).

17Who is a rider#

  1. (1)A rider is the person who is riding a motorbike, bicycle, personal mobility device, animal or animal-drawn vehicle.
  2. (2)A rider does not include—
  3. (a)a passenger; or
  4. (b)a person walking while pushing or pulling a bicycle or personal mobility device.

19Reference to driver includes rider etc.#

Unless otherwise expressly stated in this regulation, a reference in this regulation (except in this division)—

  • (a) to a driver, includes a reference to a rider; and
  • (b) to driving, includes a reference to riding.
