208Parallel parking on a road (except in a median strip parking area)#

  1. (1)A driver who parks on a road (except in a median strip parking area) must position the driver’s vehicle in accordance with subsections (2) to (8).
  2. (2)The driver must position the vehicle to face—
  3. (a)in the direction of travel of vehicles in the marked lane or line of traffic on, or next to, the part of the road where the driver parks; or
  4. (b)if there is no traffic on, or next to, the part of the road—in the direction in which vehicles ordinarily travel on, or next to, the part of the road.
  5. (3)If the road is a two-way road, the driver must position the vehicle parallel, and as near as practicable, to the far left side of the road.
  6. (4)If the road is a one-way road, the driver must position the vehicle parallel, and as near as practicable, to the far left or far right side of the road, unless otherwise indicated by information on or with a parking control sign.
  7. (5)If the driver does not park in a parking bay, the driver must position the vehicle at least 1m from the closest point of any vehicle in front of it and any vehicle behind it.
  8. (6)If the road has a continuous dividing line or a dividing strip, the driver must position the vehicle at least 3m from the continuous dividing line or dividing strip, unless otherwise indicated by information on or with a parking control sign.

Maximum penalty—20 penalty units.

  1. (7)If the road does not have a continuous dividing line or a dividing strip, the driver must position the vehicle so there is at least 3m of the road alongside the vehicle that is clear for other vehicles to pass, unless otherwise indicated by information on or with a parking control sign.
  2. (8)The driver must position the vehicle so the vehicle does not unreasonably obstruct the path of other vehicles or pedestrians.
  3. (9)This section does not apply to—
  4. (a)a driver if the driver parks on a length of road, or in an area, to which a parking control sign or road marking applies, and information on or with the sign or road marking includes the words ‘angle parking’ or ‘angle’; or
  5. (b)the rider of a motorbike if the rider parks the motorbike on a length of road, or in an area, to which a permissive parking sign applies and the sign indicates that the length of road or area is for parking motorbikes.
  6. (10)Subsections (3) and (4) do not apply to the rider of a motorbike if the rider positions the motorbike so at least 1 wheel is as near as practicable to the far left or far right side of the road.
  7. (11)If a road has 1 or more service roads, the part of the road used by the main body of moving vehicles, and each service road, is taken to be a separate road for this section.
  8. (12)In this section—
continuous dividing line
means—
(a)
a single continuous dividing line only; or
(b)
a single continuous dividing line to the left or right of a broken dividing line; or
(c)
2 parallel continuous dividing lines.
road
does not include a road-related area, but includes any shoulder of the road.
  1. (1)A driver who parks in a road-related area (except in a median strip parking area) must position the driver’s vehicle to face—
  2. (a)in the direction of travel of vehicles in the marked lane or line of traffic next to the part of the road-related area where the driver parks; or
  3. (b)if there is no traffic next to that part of the road-related area—in the direction in which vehicles could lawfully travel in the road-related area; or
  4. (c)if the road-related area is an area that divides a road—either—
  5. (i)in the direction of travel of vehicles in the marked lane or line of traffic to the left of the driver; or
  6. (ii)if there is no traffic to the left of the driver—in the direction in which vehicles could lawfully travel on that part of the road.
  7. (2)Subsection (1) does not apply if signs or road markings indicate that angle parking is required in the road-related area.

Maximum penalty—20 penalty units.

209Parallel parking in a median strip parking area#

  1. (1)This section applies to a driver who parks in a median strip parking area if a parking control sign or road marking applies to the area, and information on or with the sign or road marking indicates that the driver's vehicle must be positioned parallel to the median strip.
  2. (2)The driver must position the driver's vehicle—
  3. (a)to face—
  4. (i)in the direction of travel of vehicles in the marked lane or line of traffic to the left of the driver; or
  5. (ii)if there is no traffic to the left of the driver—in the direction in which vehicles ordinarily travel on the part of the road to the left of the driver; and
  6. (b)parallel, and as near as practicable, to the centre of the median strip; and
  7. (c)if the driver does not park in a parking bay—at least 1m from the closest point of any vehicle in front of it and any vehicle behind it.
  8. (3)This section does not apply to the rider of a motorbike.

Maximum penalty—20 penalty units.
